LOCAL CASE PROCESSING PROGRAMS
Since July 2001, the Criminal Division of the Court of Common Pleas of Montgomery has operated on an individual assignment basis. As transcripts are filed with the Clerk of Courts, the cases are randomly assigned by computer on a rotation basis to one of six judges sitting in the Criminal Division. The Court Administrator will schedule the case for a pretrial conference before the judge within five to eight weeks following arraignment in the Court of Common Pleas. The cases will either be diverted for ARD or result in a guilty plea or will be called for trial. Negotiated pleas are accepted and sentence imposed on the day of the pretrial conference. "Open" guilty pleas are taken on the day of the conference and a pre-sentence investigation is generally ordered with sentence imposed within 90 days. If a case is called for trial, the case will be listed for trial by the Court Administrator on the next available trial list for tial before the designated judge. This individual calendar system, a change from our prior "master list" system, has improved productivity and efficiency, and ensures the more equal distribution of criminal cases among the six Criminal Division judges. Homicide cases are assigned by the Criminal Administrative Judge, also on a rotating basis.
Special Sentencing Programs
There are no other special case processing programs to report other than traditional ARD and county intermediate punishment programs including inpatient and outpatient treatment programs, work release, and community service.
