May Legislative Lunch and Learn: What Happens After the Sentence: Supervision, State Parole, Revocation, and Resentencing in Pennsylvania
This session will provide an overview of what occurs after a sentence is imposed in Pennsylvania, with a focus on supervision, state parole, violation proceedings, revocation, and resentencing. While sentencing marks a critical point in the criminal justice process, many cases continue through periods of supervision that may result in additional court involvement or a return to custody.
Staff will walk through the lifecycle of a case following sentencing, including the role of county probation supervision, the identification and handling of violations, and the circumstances under which cases return to court. The session will also provide an overview of the legal framework governing revocation and resentencing, including the court’s authority under 42 Pa.C.S. § 9771 and the application of the Commission’s resentencing guidelines.
In addition, the discussion will include a high-level overview of state parole supervision and recommitment, including how cases transition from county to state supervision, the role of the parole board, and the circumstances under which individuals may be recommitted to serve additional time.
The session will highlight practical considerations observed in the field, including variations in how cases proceed through supervision and revocation, as well as the challenges associated with consistently capturing this activity in statewide data systems.
