Resentencing

Act 81 of 2008 required the Commission to adopt Resentencing Guidelines that take into account: factors considered in adopting sentencing guidelines, the seriousness of the violation, and the rehabilitative needs of the defendant. Upon revocation of a sentence of probation for technical and/or conviction violation(s), all sentencing alternatives available to the Court at the time of the initial sentence are available to the court for resentencing. The Court must consider Resentencing Guidelines when resentencing a convicted person following the revocation of probation.

Resentencing Guidelines for the 7th Edition Sentencing Guidelines became effective January 1, 2020. Amendment 2 to the Resentencing Guidelines for the 7th Edition Sentencing Guidelines take effect January 1, 2024, and are reserved for reference in 204 Pa. Code §§ 307.1—307.4.

The Resentencing Guidelines for the 8th Edition Sentencing Guidelines apply to all resentences following revocation of probation for sentences imposed under the 8th Edition Sentencing Guidelines; and are applicable to offenses committed on or after January 1, 2024. Resentencing Guidelines for the 8th Edition Sentencing Guidelines are set forth in 204 Pa. Code §§ 307a.1—307a.4.
